عن عائشة رضي الله عنها قالت قال رسول الله صلى الله عليه وسلم لا هجرة بعد الفتح ولكن جهاد ونية وإذا استنفرتم فانفروا متفق عليه ومعناه: لا هجرة من مكة لأنها صارت دار إسلام
"Meaning: From 'A'ishah, he said: Messenger of Allah sallallaahu' alaihi wa sallam said: There is no emigration after the conquest of Mecca, but Jihad and intentions, and if you are asked to go for jihad then go" [1]
Meaning: There is no emigration from Mecca because he has become the land of Islam. [2]
Legal issues that jihad fard 'ain is a major problem that has not been known by the Muslims. Berfatwa so many preachers and called the legal jihad (perceived) fard 'ayn for every individual, no basic rules are clear, and sometimes made in order to realize personal desires and the particular group of people. Therefore in this opportunity, we feel the need to include a brief explanation about it from one of the scholars who have been known to science and kesholehannya, so we all can do good on the science, and hopefully taufiq God gave Him to us to walk in a straight path.
Sharh Hadith.In this hadith the Prophet sallallaahu 'alaihi wa sallam said there was no emigration after the conquest of Mecca with his saying:
لا هجرة
There is no emigration.
Negation is not for the generality, meaning emigration was not canceled with the conquests of Mecca, because the move will not be lost until the Day of Resurrection as already exist in the hadeeth of the Prophet sallallaahu 'alaihi wa sallam.
لا تنقطع الهجرة حتى تنقطع التوبة ولا تنقطع التوبة حتى تطلع الشمس من مغربها
"It means: Hijrah uninterrupted until repentance is lost, and repentance is not interrupted until the sun rises from the west" [3]
However, there is a move here is the absence of emigration from Mecca, as stated by the author (Imam Nawawi) above, because after the conquest of Mecca a Muslim country and after that it will again be a heathen country, with this basis that the Prophet sallallaahu ' alaihi wa sallam abolish emigration after the conquest of Mecca.
Mecca formerly under the power of the Pagans, they had expelled the Prophet sallallaahu 'alaihi wa sallam from him, then he sallallaahu' alaihi wa sallam emigrated to Madinah with the permission of his Lord. After eight years of the Prophet sallallaahu 'alaihi wa sallam in Medina, he returned to Mecca and defeated him to become the land of Mecca and the Islamic faith, and thus no longer move from there.
In this hadith there is the argument that shows that Mecca would not return to infidel country, but it remains a land of Islam till the Day of Judgment comes, or until the time that Allah Subhanahu wa Ta'ala will.
Then the words of his: ولكن جهاد ونية "But the jihad and intention"
Significant: after this command is jihad, which is out of Makkah in Makkah for jihad. And "waniyyatun" means: a good intention to strive in the path of Allah, the jihad way is intended to enhance the sentence of God.
Then he said :: وإذا استنفرتم فانفروا "And if you are asked to go for jihad then go".
Means: If waliyul amri (government) asks you to go for jihad in Allah's way, then you must go for jihad, and jihad at the time the law is fard 'ayn. Then do not meet anyone, except those who have received udzur Allaah on the grounds of his word.

ياأيها الذين ءامنوا مالكم إذا قيل لكم انفروا في سبيل الله اثاقلتم إلى الأرض أرضيتم بالحياة الدنيا من الأخرة فما متاع الحياة الدنيا في الأخرة إلا قليل إلا تنفروا يعذبكم عذابا أليما ويستبدل قوما غيركم ولاتضروه شيئا والله على كل شىء قدير
"Meaning: O ye who believe, is why when it is said unto you: 'Depart (for fighting) in Allah' ye cling heavily to the earth. Are you satisfied with life in the world in exchange for life in the hereafter? When enjoyment of life in the world (as opposed to life) in the Hereafter. If ye go forth, Allah will punish with a grievous penalty, and the replacement of (you) with another people, and you will not be able to give him the slightest harm . Allah hath power over all things "[At-Tawbah: 38-39]
This is one of the state of jihad is fard a'in diuhukumi.
The second situation: If the enemy surrounded the State, meaning the enemy came to attack the country and besieged it, then the jihad at a time when it becomes fard 'ayn. In these circumstances every man must fight, including women and elderly people are able to jihad. Since this is a defensive jihad (jihad difa ') and a defensive war is different from attacking MUSHs war (jihad tholab), resulting in a situation like this all the people set out to defend their country.
The third situation: If there is fighting, the two warring sides facing each other, the rows of the infidels the ranks of the Muslims, the jihad at the time the ruling fard 'ain and one should not turn away, as the word of God.
ياأيها الذين ءامنوا إذالقيتم الذين كفروا زحفا فلا تولوهم الأدبار. ومن يولهم يومئذ دبره إلا متحرفا لقتال أو متحيزا إلى فئة فقد بآء بغضب من الله ومأواه جهنم وبئس المصير
"Meaning: O ye who believe, when ye meet those who disbelieve are attacking you, then do not back to them (back). Person who turned them (back) at the time, except for the turn (maneuver) or going to war merged with other forces, then surely the man returned with wrath from Allah, and his place is hell. And so have his home Evil "[Al-Anfal: 15-16]
Thus the Prophet sallallaahu 'alaihi wa sallam classify escaped from the battle field, including the seven major sins. [4]
The fourth situation: If one takes, for example: no one knows except the weapon use only one person, and people need that person to use the new weapons, then it is obligatory upon it to strive even priests (waliyul amri) did not ask him to leave and that obligation there because he needed.
Then in the fourth state of jihad is a fard 'ain, and that in others is fard kifaya.
Ilmi Ahl stated that mandatory upon the Muslims to make the most of their jihad once every year [5], jihad fighting the enemies of Allah in order to exalt the word of Allah, not just defending the State. For defending the country, solely as a country, it can do the believers and unbelievers. Infidels-even defend their country. However, a Muslim just to defend the religion of Allah, so he was defending his country not because just as one country but because he is a Muslim country, and he defended in order to preserve Islam. It is therefore obligatory upon us to state that we are facing today, to remind all people that call to liberate the country and is similar to it is a call that does not fit, and mandatory for us to educate people with religious education. And be said: We are defending our religion before the others, because our country is the state religion and Islamic countries in need of protection and defense, then we must defend it with intention.
As for defending the intent of nationalism or ethnicity then this happens to believers and unbelievers, and the act was of no benefit to the perpetrators on the day of Judgment, if killed in a state with the intention to defend this country so he did not die a martyr; because the Prophet sallallaahu 'alaihi wa sallam asked about someone who is fighting for pride (pride) and fight for his courage and fighting just because I wanted to show his prowess, which is said to be the name of Allah, then he would say.
من قاتل لتكون كلمة الله هي العليا فهو في سبيل الله
"Meaning: Who is fighting for the sentence of God to be high, it was he who was in the way of Allah" [6]
Note this requirement! If you fight for the country, then you and the unbelievers together, but the fight because they want to enforce the sentence of God is held in your country because your country is an Islamic state, then in these circumstances that the war may be said the war in the way of Allah.
Have authentic from the Prophet sallallaahu 'alaihi wa sallam, that he said.
ما من مكلوم يكلم في سبيل الله والله أعلم بمن يكلم في سبيل الله إلا جاء يوم القيامة وجرحه يثعب دما اللون لون دم والريح ريح مسك
"It means: No injuries were injured in the way of God and God is to know who was hurt in the way of Allah unless it comes to judgment in the state of the wound to bleed, color is the color of blood but the scent fragrance Misk (kasturi oil)" [7]
Notice how the Prophet sallallaahu 'alaihi wa sallam requires martyrdom by fighting only in Allah, then it is obligatory upon the claimant to explain the science of this issue to the people.
And Allaah is the Source of strength
